Terms & Conditions – Makala Transportation LLC

By accessing, booking, or using the services of Makala Transportation LLC (“Company,” “we,” “us,” “our”), you (“Client,” “you,” “your”) agree to be legally bound by the following Terms & Conditions. These Terms constitute the entire agreement between you and Makala Transportation LLC and supersede any prior understandings or representations.

All transportation services are subject to availability and are confirmed only upon full or partial payment, written acceptance, or electronic confirmation. Rates are provided at the time of booking and may be subject to additional charges including, but not limited to, extended wait times, traffic delays, route deviations, cleaning fees, damages, or additional stops requested by the Client. The Company reserves the right to refuse service at its sole discretion. Full payment may be required prior to the commencement of service.

Cancellations must be made no later than twenty-four (24) hours before the scheduled service to avoid penalties. Cancellations made after this period, as well as no-shows, may result in charges up to one hundred percent (100%) of the total fare. Refunds, if issued, will be made to the original form of payment, less any applicable cancellation fees.

The Company maintains commercial liability insurance as required by law; however, we are not liable for loss, theft, or damage to personal belongings. Clients assume full responsibility for any damage caused to vehicles or equipment due to negligence, misuse, or failure to comply with driver instructions. Any claims must be submitted in writing within seven (7) days of the incident.

For safety, all passengers must adhere to applicable laws, safety regulations, and instructions provided by the driver. Smoking, illegal activity, excessive intoxication, harassment, or disorderly conduct are strictly prohibited. The Company reserves the right to immediately terminate service, without refund, in the event of unsafe or inappropriate behavior, or if conditions are deemed hazardous.

The Company shall not be held liable for delays, interruptions, or cancellations due to circumstances beyond its reasonable control, including but not limited to traffic conditions, weather events, road closures, accidents, vehicle breakdowns, or acts of God. Under no circumstances shall Makala Transportation LLC be held responsible for indirect, incidental, or consequential damages.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Hawaii. Any disputes shall be resolved exclusively in the courts of Hawaii County. If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
